Terms & Conditions

Before using or subscribing to dns.he.net, please review the
following terms and conditions which define your rights, responsibilities,
and benefits as a user of Hurricane Electric (he.net) dns service.

dns.he.net License and Terms and Conditions of Use. Dns.he.net
is an Internet service (the "Service") owned and operated by Hurricane Electric,
LLC. (hereafter "we","Hurricane"). "You" or "your" means an adult user
of the Service for itself and you as parent or guardian for any minor which you
allow to access the Service, for whom you will be held strictly responsible.
Your use of the Service indicates that you are bound by this agreement with
us. If you don't agree with any of these terms and conditions, don't use the
Service. We may alter this agreement at our discretion and your continued use
after any change indicates your acceptance of that change. If you don't want
to be bound by a change, discontinue use of the Service.

Hurricane reserves the right to remove or block any user provided records
that comes to its attention and that it believes, in its sole discretion, 
(i) is illegal, obscene, indecent, defamatory, incites racial or ethnic hatred,
(ii) violates the rights of others, or degrades the performance of the service. 
(iii) abuse or fraudulently use the Service, (iv) use the Service in a
manner that causes interference to or tampers with another subscriber's or 
authorized user's use of the DNS service, or (v) otherwise use the
Service in a manner that violates this TOS. The terms of this TOS apply to any 
application or use of the Services.

Activities that fall within the scope of C(i), (ii), (iii), (iv) or (v) above 
include, but are not limited to, the following: 

Transmitting Unsolicited Commercial Email (UCE)
Transmitting bulk email
The sale or promotion of software relating to Unsolicited Commercial Email (UCE)
Posting bulk Usenet articles
Denial of Service attacks of any kind
Copyright infringement
Phishing
Failure to provide legitimate contact information
Misrepresentation of Hurricane's DNS services
Reselling or attempting to resell Hurricane's DNS services
Unlawful or illegal activities of any kind
Use of web redirects for distributed file sharing software and networks
Causing lossage or creating service degradation for other Hurricane DNS Users, 
	whether intentional or inadvertent
Causing or attempting to cause harm to another computer or network
Violating any applicable law or regulation
Utilizing the Hurricane DNS service under more than one account
Search engine spamming and/or click fraud

Any record removal requests should be directed to the submitters of that data. 
In the event that a submitter dies, the records will remain online unless
the family or executor of the estate removes the records using the submitter's
username and password. Sites hosted by dns.he.net are not monitored. 
We request that all using this service comply with the Terms and Conditions 
as well as general Internet etiquette. If it is brought to the attention 
of Hurricane that a DNS record violates the Terms and Conditions, that 
record and/or account will be suspended and/or removed and blocked.

Hurricane makes no representations concerning the suitability,
reliability, or accuracy of the Content or the service provided on the
Service for any purpose. The Service is provided on a best effort basis
and provides no service level agreement (SLA). We disclaim all warranties, 
expressed or implied, in connection with the Content and the services 
provided on the Service, including conditions of merchantability, fitness 
for a particular purpose, title and non-infringement. In no case will we be 
liable for any direct, indirect, punitive, special or other damages including, 
without limitation, lost or delay of use, lost profits, loss of data, or 
any other damage in contract, tort, equity, or any other legal theory, 
even if advised of the possibility thereof.

Because some states/jurisdictions do not allow the exclusion or limitation of
liability for consequential or incidental damages, this limitation may not
apply in part to you. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THIS WEB
SERVICE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS
TO DISCONTINUE USING THIS SERVICE.

Additional Registered Member Terms

1. REGISTRATION AND SECURITY

1.1 Registration of e-mail address as well as selection of a password and
Membership name

("Username") are required to use some portions of this site. You must provide
Hurricane with accurate, complete, and updated registration
information. Failure to do so will breach this Agreement. You understand that
you may not

(i) select or use a name of another person with the intent to impersonate
that person;

(ii) use the Rights of any person other than yourself without authorization;
or

(iii) use a name that we, in our sole discretion, deem offensive.

dns.he.net is operated in the United States of America and operated
to be in compliance with the laws of the United States. Access is governed by
these terms and conditions under the laws of the State of California and the
United States. Registration as a user of or subscriber to any of the services
provided on them results in your customer information being stored and
processed in the United States, and you, in registering or subscribing,
specifically consent that storage and processing. You may access that
information at any time to confirm its correctness and to keep it current in
connection with your registration or subscription. If you are subscribing or
registering for use of this site from outside of the United States of
America, you consent to the storage and processing in the United States of
the personal data you submit.

1.2 You shall notify us by regular mail or by e-mail at dnsadmin@he.net
of any known or suspected unauthorized user(s) of your account, or any known
or suspected breach of security, including loss, theft, or unauthorized
disclosure of your password. (b) You will be responsible for maintaining the
confidentiality of your password. You will never be required to reveal your
password to any representative or agent of Hurricane, its owners or
agents.

1.3 You are responsible for all usage or activity on dns.he.net via
your password account. Distribution of your password for access to
dns.he.net is expressly prohibited and shall constitute a breach of
this Agreement. Any fraudulent, abusive, or otherwise illegal activity may be
grounds for termination of your account, at our sole discretion, and you may
be referred to appropriate law enforcement agencies.

2. TERMINATION OF SERVICE 

Hurricane Electric may suspend or terminate your account or access rights to 
Services at any time, without notice, for conduct that Hurricane Electric reasonably
believes violates this TOS or any other applicable policies or guidelines that 
Hurricane Electric has posted on the Hurricane Electric DNS or corporate Web site. 
In addition to restricting or terminating Customer's access to the Service, Hurricane
may remove any materials that we have reasonable grounds to believe are in
violation of the copyright laws of the United States or may be otherwise illegal,
may subject us to liability or that violate this TOS. Hurricane may also
cooperate with legal authorities and/or third parties in the investigation of any
suspected criminal activity.

3. COMMUNICATIONS BETWEEN Hurricane AND YOU.

If you are a registered user, Hurricane may send electronic mail to
you, for the purpose of password recovery upon request, administrative
communication regarding questionable DNS records in your account, informing
you of changes or additions to dns.he.net, or of any
Hurricane related services.

4. MODIFICATIONS TO THIS AGREEMENT AND THE SERVICE.

Hurricane has the right, at its sole discretion, to modify this
Agreement or the Service at any time. Changes in service will be posted at
dns.he.net, or sent via e-mail. In addition to this general
acceptable use policy, other specific policies may apply to websites, mailing
lists, message boards, and other facilities at dns.he.net. Continued
use of the service now or following posted notices of changes in this
Agreement means that you have accepted and are bound by the changes.

5. MISCELLANEOUS

This Subscriber Agreement is governed by the law of the State of
California, without regard to its principles on conflicts of laws, and the
federal law of the United States of America. Any action to enforce this
Agreement shall be brought in the federal or state courts located in 
Fremont, California.
